A Federal High Court sitting in Kano has nullified the election of Shaaban Ibrahim Sharada, Personal Assistant to President Muhammad Buhari on broadcast media as APC flag bearer for Kano Municipal federal constituency and confirmed Mutari Ishaq Yakasai as the legitimate candidate.
Delivering the judgment on Tuesday the trial judge, Saadatu Ibrahim upheld the result of primary election in which Mutari Ishaq emerged as APC candidate to represent Kano Municipal constituency in the House of Representatives.
She said, based on section 3 of the electoral act, political parties lack jurisdiction to substitute candidates elected through legitimate process.
Nuraini Jimoh, counsel to Mutari Ishaq Yakasai expressed satisfaction with the ruling describing it as a victory to democracy.
Commenting on the judgment, counsel to INEC Hassan Aminu expressed hope that the ruling would serve as a lesson to political parties to live up to expectation.
However, counsel to Shaaban Ibrahim Sharada expressed dissatisfaction with the ruling and said the defendant will appeal to a superior court of competent jurisdiction.
It could be recalled that, Mutari Ishaq has sued All Progressive Congress, Independent National Electoral Commission (INEC) and Shaaban Ibrahim Sharada for substituting his name as APC flag bearer for Kano Municipal federal constituency in House of Representatives with that of Shaaban Ibrahim Sharada.
